Judge dismisses vaccine mandate lawsuit brought by employees of Ochsner Lafayette General

LAFAYETTE, La. (KADN) - A 15th Judicial District judge has dismissed a lawsuit about Lafayette Ochsner General's vaccine mandate for employees.

News 15's Kourtney Williams was inside the courtroom for the hearing Thursday afternoon.

Ochsner Lafayette General adopted their mandate on August 24, 2021 requiring physicians, students, vendors, staff and residents to take the COVID-19 vaccine by October 29, 2021.

Employees sued Lafayette General. Their attorney argued that it was an invasion of privacy to force employees to disclose their vaccination status.

Attorneys for the hospital argued it was an act of employment.

The judge dismissed the case, citing that Ochsner is a private employer. Therefore, the judge said, the mandate's not unlawful or unconstitutional.

Jimmy Faircloth, attorney for the hospital employees, said they would be filing an appeal.

This is one of two cases brought against Lafayette medical centers.

The other, against Our Lady of Lourdes Regional Medical Center, is scheduled for a hearing on Friday.

Faircloth also represents the plaintiffs in that case.
